McConnell got the KY state legislature to pass a law that any Senate vacancy has to be filled by an appointee from the same party as the departing Senator. I don't know if Beshear has to appoint someone recommended by the KYGOP or if he can choose any Republican he wants.
He vetoed it and it was overriden by the legislature. It's the law, unfortunately. He can certainly challenge it, but good luck winning in the 6th Circuit or SCOTUS.
